Landlord Information


Terms & Conditions


1) Tenant Referencing and Marketing.
We will market your property and obtain references on prospective tenants from appropriate sources i.e. business, personal and financial (which may include a credit check).  Once an application fee has been received from a prospective tenant you cannot vary the service provided on the Landlord Acceptance Form.
2) First Month Transfer of Rents
Provided we are given the landlord’s bank or building society account details we will process a payment to be placed into the bank transfer system (BACS)  within seven working days commencing from our receipt of cleared funds. A further number of banking days will be required for the payment to reach your account.
3) Tenancy Agreements
Buyandlet.co.uk (hereinafter referred to as B&L.co.uk) have prepared a comprehensive Tenancy Agreement that has been drawn up specifically to cover present day legislation and to protect your interests. The cost of drafting the document is split equally between the landlord and the tenant. Extensions to Agreements will be charged at £30.00 plus VAT to each party.
4) Inventories and Schedule of Conditions
We recommend you have an Inventory prepared prior to letting your property. Unless otherwise instructed we will make the necessary arrangements for this service to be carried out.  We will not accept any responsibility should landlords prefer to carry out their own inventory.
5) Repairs
We will investigate any faults reported at a property and instruct contractors to carry out repairs. In the case of minor repairs or emergencies (up to £100.00 excluding VAT) these works will be carried out immediately without reference to you..  For repairs (over £100 excluding VAT)  we will require your consent . Where major works are necessary, for example roofing, replacement of a boiler or re-decoration, an estimate will be obtained and forwarded  to you for approval. 
6)  Visits
B&L.co.uk will carry out regular visits which will provide an up to date picture and enable us to monitor the performance of the tenant in respect of their contractual obligations. Such visits will also allow your tenant to communicate direct with us ‘on-site’ should they have specific requests or queries with their accommodation or tenancy. A report will be sent to you for information, which will include reference to the current condition of the property and comments with regard to any recommendations or tenant’s requests.
7) End of Tenancy
At the end of the tenancy and pending your return we will help to arrange for the utilities to be transferred back into your name. We will provide our experience to assist in equitably mediating on dilapidations. However, where we are holding the deposit as ‘stakeholders’, we will require the tenant’s express consent before we can disburse the deposit.
8) Finance Act 1995
The Self-Assessment system applies to all taxpayers including those earning income from property (whether UK or Overseas Resident) and also includes government employees. The Inland Revenue may issue an ‘exemption’ certificate to landlords, which authorises B&L.co.uk to transfer rent to overseas landlords without deduction of tax. However, where no ‘exemption’ certificate is available we are legally bound to deduct tax at the basic rate before remitting rents. Where no agent is employed to manage a property, the tax deduction is the responsibility of the landlord.
9) To Let Boards
At our discretion we will erect a ‘To Let/Let By’ board unless otherwise instructed.
10) Rental and Legal Protection

11) Tenants Breaches

Should the tenant fall behind with the rent or should we become aware of any other breaches of the Tenancy Agreement you will be informed accordingly. If it becomes necessary to take legal action you will be responsible for instructing your solicitor and for all fees arising.
 
LANDLORD’S OBLIGATIONS


1) Consent to Let
If you have a mortgage you must obtain a letter of consent from your mortgage lender. If your interest in the property is leasehold your lease may require you to obtain written consent from your landlord prior to sub-letting.
2) Insurance
It is essential that you notify your insurance company of your intention to let so that they may advise you of any additional cover that may be necessary. Legal protection, contents and building insurance are available to landlords and details can be obtained from B&L.co.uk
3) Change of Ownership
In the event of the property being sold or passed on with the benefit of the tenancy, B&L.co.uk will look to the original landlord of the property for the letting commission due for the introduction of the tenant for however long the same tenancy lasts, whether or not subsequent extensions of the initial terms are negotiated by B&L.co.uk or their representatives or by the landlord (old or new) or any other persons or agents.
4)  Selling to the Tenant
In the event that a tenant introduced to you by B&L.co.uk negotiates the purchase of the property, which he/she is renting or had been renting within the previous six months, B&L.co.uk will charge a commission of 1% of the negotiated purchase price. The fee is payable upon completion whether or not negotiations have been carried out by B&L.co.uk. All fees are subject to VAT at the prevailing rate.
5) Fee changes
B&L.co.uk reserves the right to vary the quoted fee rate during the course of the tenancy by giving three months notice of their intention to do so.
6) Fire and Safety Regulations
Landlords should be aware that the furniture they provide must comply with the Furniture and Furnishings (Fire)(Safety) Regulations 1988 which were amended in 1993 and have set new levels of fire resistance for domestic upholstered furniture and furnishings. All property let for the first time since 1st March 1993 must contain furniture that complies with the new regulations and ALL furniture must comply with effect from 1st January 1997. The provisions are complex and we will advise you at the time of taking instructions whether or not any furniture in your accommodation needs to be replaced. It is an offence to breach these regulations and we suggest you obtain a comprehensive guide, including details of labels indicating compliance, from your local Trading Standards Office. The landlord hereby warrants to the Agent that all furniture and furnishing in the property to be let and included in the letting fully comply with the requirements of the Consumer Protection Act 1967 and all statutory instruments made under it including in particular, the Furniture and Furnishings (Fire)(Safety) Regulations 1988 as amended by the Furniture and Furnishings (Fire)(Safety)(Amendment) Regulations 1989 and 1993.
7) Gas Safety Regulations
The Gas Safety (Installation and Use) Regulations 1994 came into force on 31st October 1994 and applies to all domestic properties. These regulations compel landlords to have all gas equipment safety checked annually by qualified persons only and to keep records of work carried out on the appliances. These records must be available upon request for inspection by any tenant. The landlord hereby warrants to the Agent that he agrees to undertake the responsibility for the safety checks on all gas equipment in the property to be let and to provide a certificate in accordance with the Gas Safety (Installation and Use) Regulations 1994.
8)Electrical Safety Regulations
These regulations impose an obligation on landlords to ensure that all electrical appliances are safe and we recommend that a qualified electrician carry out a safety check.
The landlord hereby warrants to the Agent that all electrical items are safe and that he agrees to undertake the responsibility for the safety checks in accordance with the Electrical
Equipment (Safety) Regulations 1994.
9) Executing the Tenancy Agreement
It is a requirement for landlords to sign their own Tenancy Agreement. Therefore, it is important, that we are given clear written instructions regarding the length of time the property will be available for letting and that we have a contact address, telephone and fax number in order that the document may be forwarded for signature prior to any tenancy.
10) Letting and Management Fees -
General: Fees and commissions are confirmed on the Terms of Acceptance and they will be payable by the Landlord to the Agent, subject to VAT at the prevailing rate. There is a minimum fee of £50.00 plus VAT  should the Landlord withdraw from a prospective tenancy. An administration fee will become payable to cover costs incurred by B&L.co.uk.
11)Indemnity / Ratification
The owner undertakes to ratify whatsoever the Agents shall lawfully and reasonably do by virtue of this Agreement and to indemnify them against all costs and expenses properly incurred by them in carrying out their duties and all other actions and acts pursuant hereto including legal expenses.
